Should that not be “never ask for whom the bell tolls, for it tolls for the”…..It seems to me that the overspending legal action against Bob the builder in the Court was in effect a “class action” in Winston’s name. Glenn agreed to pay the legal fees on condition Winston assured him that the confidence and supply agreement would last to the next election. Brian Henry’s “client” could be any member of the public especially a Tauranga resident,voter or concerned citizen.

It was my understanding that a “class action” requires a minimum number of ‘formal’ plaintiffs. As this opinion may have been overly influenced by knowledge of the USA’s laws, could anyone out there with knowledge on this aspect of NZ law enlighten me as to what the rules here are?

The plaintiffs could be all those Tauranga voters who voted for Winston in Tauranga - Winston (a solicitor) instructs Henry (a Barrister)on behalf of those voters - but whether they can be classed as formal I dont know …like you I’m not a lawyer . Winston may not be liable to pay the fees - the voters who voted for Winston believe Bob overspent. So Henry asks Glenn for the fees. His client is Winston the solicitor for the affected voters who in fact owe the debt - Glenn is paying their fees not Winstons. I could be wrong but in a way I think Williams and Peters in the first instance intimated this….this is so basic !!!!
